Judicial Candidates Evaluation

Attention All Practicing Attorneys

 

TODAY, Monday, March 17, the MCBA is releasing the 2008 Judicial Candidates Evaluation. The invitation to participate in the JCE will only be distributed electronically via email through a third-party vendor.

 

If an attorney does not have email, but wishes to participate, the attorney should call the MCBA at 546-1817 and ask for Liz Novak, and she will be happy to provide a paper evaluation to complete and return to the MCBA.

If you anticipate, but do not receive the electronic invitation to participate by mid-day on TUESDAY, we ask that you first check your SPAM folder and make certain it was not blocked.

If in fact it appears you did not receive it, please contact Liz Novak for a new email link. Important reminder-- email links cannot be shared with colleagues. Each participant receives a unique link. If you have questions, please feel free to call 546-1817.

It’s Ok to Disagree

Recently, I called a colleague of mine, Elizabeth Derrico, Associate Director, Bar Management & Information for the American Bar Association, to speak with her about the public defender debate -- specifically, the MCBA's role in this dialogue.

With more than 25 years in bar association work, she is someone I often turn to when seeking counsel. She has always been able to enlighten and challenge me no matter what the topic.

I gave her the quick overview of the Bar's role in the Public Defender process more than 30 years ago, along with our offer to again assist in the facilitation of the process due to Ed Nowak’s retirement. I provided her with an overview of everyone’s work on the issue, the resolution put forth by the Board of Trustees, and explained that as the issue grew increasingly heated, the bar began to receive a multitude of responses from members through a variety of methods.

My question to Elizabeth--how does an association choose what issues/debates they take on? Is it up to the president or the board to decide? Should the membership weigh in, acknowledging that membership is comprised of a politically diverse group? How do we pick the issues?

Recovering from the
Regrettable Public Defender Selection Controversy

The unfortunate turmoil that preceded the County Legislature's appointment of our new Public Defender must never happen again. What should have been a wonderful opportunity for the entire Rochester community to celebrate our undivided commitment to providing equal justice to all---as exemplified in our highly respected, independent and non-partisan Office of Public Defender---instead devolved into a community embarassment. What began as an effort to maintain the apolitical standing of this public office somehow mutated into a contentious political squabble.

The MCBA was immersed in this public debate from the outset, as our Board of Trustees unanimously adopted a resolution early last December, urging the County Legislature to adopt the same non-partisan, merit-based screening process that our Association conducted three decades ago in selecting our last Public Defender and just four years ago in selecting our County's Conflict Defender.
